1. Research |
If you have any credit agreements taken out between April 2002 and
April 2007, you may be able to make a claim under the Consumer Credit
Act 1974. This website provides you with the information necessary to
make a claim. If you decide to do so, then fill in our free online
audit assessment and within minutes we can give you an indication of
any eligible claim. You are then free to decide whether you wish to go
ahead, with no obligation. |
2. Quickfire Online Test |
Our secure online form will require you to provide some basic
information about your credit agreements as well as some personal
details about yourself. It will take approximately two minutes to
complete. |
3. Underwriting |
Each credit agreement is assessed on its own merits. A
'yes' or 'no' decision will be given within minutes. If the assessment
returns a 'yes' decision, it may be possible for our legal team to make
a claim on your behalf to:
- Cancel the agreement and clear any outstanding balance
- Claim back any charges that may have already been paid
- Reclaim any interest that you may have paid on any outstanding balances
- Claim for repayments previously made
|
4. Your Instruction |
You may pursue more than one claim at any one time, but for each
individual claim you will be required to read and understand
Debtonator's terms and conditions.
There will be a 14-day cooling-off period.
We will notify you of the claims we are pursuing on your behalf, and we
will provide you with a legal representative to carry out the claim
process and keep you regularly informed of its progress. |
5. Allocation of Case |
In accordance with the Data Protection Act all relevant
information regarding the respective credit agreement will be requested
by us from the lender. Your lender may request a fee for supplying this
information, but the maximum they can charge (per case) is £10.00. We
will at this time allocate your case to a member of our legal team. |
6. Legal Representation |
The legal representative allocated to your case will prepare and actively pursue the claim on your behalf.
They will endeavour to:
- Cancel the agreement and clear any outstanding balance
- Claim back any charges that may have already been paid
- Reclaim any interest that you may have paid on any outstanding balances
- Claim for repayments previously made
Remember! If your claim has been made on our 'no win, no fee' option,
your legal representative and Debtonator are paid only if your claim is
successful. |
7. Repayment |
Upon successful completion of a claim, all reclaimed money is paid to your legal representative. This may include the following:
- Interest paid
- Payments made
- Charges paid
Furthermore, your agreement will show a zero balance and there will be a 'balance paid in full' entry in your credit file.
Any fees due (see 'FAQs') will be deducted at this stage and the balance sent to you.
Remember! If your claim has been paid on our 'fixed fee' option no further payments are due whatsoever. |
8. Success! |
You've reached the stage where your claim has been
successful and all monies repaid, and we feel sure that you’re pleased
with the outcome. So pleased, in fact, that you’ll tell others about
Debtonator and what it can do for them. |
